These Terms and Conditions are effective from 18 June 2026.

In these Terms and Conditions

'You' or 'Your' means the person, school, organisation or group making a booking for use of the Community Classroom. 'We' or 'Us or 'The Council' means North Norfolk District Council of Council Offices, Holt Road, Cromer, Norfolk, NR27 9EN. 

Please read these Terms and Conditions carefully before making a booking for the classroom.

1. Age Limits

1.1. You must be 18 years old or older to make a booking. Where the booking is made on behalf of a school, organisation or group, the person making the booking confirms that they are authorised to accept these terms and conditions on behalf of that school, organisation or group. 

2. Booking

2.1. Subject to clause 2.2, you can request or make a booking for the classroom online at Holt Country Park.

2.2. Requesting or making a booking shall be regarded as an offer by you to hire or use the community classroom under these Terms and Conditions.

2.3. It is your responsibility to obtain any necessary licenses, consent or insurance. If food, music, performances, regulated activity or specialised equipment is involved it is your responsibility to tell us in advance.

3. Confirmation

3.1. Acceptance of your offer will take place when we send written confirmation of your classroom booking, which may include an automated email response. Our acceptance of your booking brings into existence a legally binding agreement between you and us. Acknowledgment of your request to book is not confirmation of the booking.

3.2. Access, arrival, departure and site instructions will be provided to you before the booking date or signposted on our website at the point of booking. For the avoidance of doubt, physical tickets will not be issued.

3.3. The classroom may only be used for the purpose set out in the booking confirmation.

4. Price

4.1. Where there is a charge for use of the classroom, you will be required to pay the full sum at the time of booking unless we agree otherwise in writing.

4.2. No payment shall be deemed to have been made until we have received cleared funds.

4.3. We reserve the right to change prices listed without notice.

5. Access and parking

5.1. The classroom is located within a countryside setting. Booking information will include, where appropriate, parking availability, proximity to parking facilities, drop-off arrangements and any restrictions that apply to vehicles on site.

5.2. Any parking charges at or near the classroom are separately payable by you and parking is not included or guaranteed with any booking unless specifically included in the confirmation from us.

5.3. Where access is provided by key, key box or other entry arrangement, you must follow the instructions given, keep any access code secure, and ensure the premises are secured at the end of the hire period unless alternative arrangements have been agreed in writing.

6. Cancellation by you

6.1. If you cancel a classroom booking, notice must be sent to holtclass@north-norfolk.gov.uk and if your request is received:

6.1.1. more than 14 days before the booking date we shall refund you the full price;

6.1.2. between 14 and 7 days before the booking date we may charge you up to 50% of the price;

6.1.3. less than 7 days before the booking date no refund shall be made.

7. Cancellation by us

7.1. All classroom bookings are subject to availability, site and premises conditions and operational requirements, and it is your responsibility to confirm the status of your booking before attending.

7.2. We reserve the right at any time and for any reason:

7.2.1. to cancel bookings and refund in full. No further liability will be accepted; or

7.2.2. to vary booking dates, times, access arrangements, facilities or the location used for the booking.

7.3. We shall endeavor to inform you as soon as reasonably possible of any booking cancellation or material variation.

7.4. Every effort has been made to ensure the accuracy of information contained within our website, literature and materials; however, we do not accept responsibility for any errors or omissions. We reserve the right to cancel any classroom booking where any such error or omission has occurred, even after we have accepted a booking.

8. Children

8.1. Any published advice about age suitability for use of the classroom or associated activities is offered as a guide. It is the responsibility of the parent, guardian, school, organisation or group leader to determine suitability for children in their care.

8.2. For safeguarding reasons, all children and young people must be appropriately supervised by responsible adults at all times. Schools, organisations and group leaders are responsible for ensuring that appropriate safeguarding arrangements, supervision ratios and consents are in place for their group.

9. Animals

9.1. Animals are not permitted in the classroom unless we have agreed this in writing in advance or the animal is an assistance animal. Where animals are permitted on site, you must follow all instructions given by us.

10. Health and safety

10.1. We are committed to ensuring that appropriate precautions are in place to protect users from dangers or hazards while using the classroom and associated outdoor areas.

10.2. We want all users of the classroom to feel confident and safe. We may implement reasonable safety or security measures where necessary, including restricting access to certain areas or prohibiting items that could present a risk to others.

10.3. Any electrical equipment bought by you into the premises must have a valid PAT certification. Portable cooking equipment is not permitted on site.

10.4. You must follow any instructions given or displayed by North Norfolk District Council representatives, site staff or authorised persons to ensure the safety of everyone using the classroom and surrounding area.

10.5. You agree to comply with our fire risk assessment by following fire instructions provided by us within the classroom and ensuring everyone in your group complies with them.

10.6. You are responsible for ensuring that all members of your group can understand relevant safety instructions, or that appropriate arrangements are in place to communicate those instructions effectively.

10.7. You are responsible for compliance with all health and safety requirements, this can include but is not limited to: occupancy limits, emergency procedures, instructions for access and safe use of equipment.

10.8. No hazardous, flammable, or dangerous substances may be brought onto the premises without prior written agreement.

10.9. We reserve the right to refuse access to the classroom or to ask any person to leave if, in our reasonable judgement, their conduct is likely to disrupt, disturb or place at risk other users, staff, visitors, wildlife, property or the surrounding environment.

11. Special assistance/reasonable adjustments

11.1. The classroom is located in a countryside setting and access routes, outdoor learning areas and surrounding terrain may be uneven or unsuitable for pushchairs, wheelchairs or similar equipment, or for those who struggle with mobility on uneven terrain.

11.2. It is your responsibility to ensure that the classroom and associated access arrangements are suitable for your group. If you are unsure, you should contact us before booking so we can provide information about the facilities and discuss any reasonable adjustments that may be available.

12. Data protection

12.1. By booking the classroom, we will collect and use the personal data you provide us for the purposes set out in clause 12.3.

12.2. Where you provide us with a third party’s personal data, you warrant and represent that you have informed them of our identity and the purposes for which their personal data will be processed.

12.3. The information you provide to us will be used for the purposes of booking and administering use of the classroom, statistical analysis and customer services. Your data will be held securely and treated confidentially and will not be disclosed to external parties other than as required for those purposes, which may include sharing your information with staff responsible for administering or supporting the booking.

13. Photographs

13.1. When you book the classroom, we may ask you to confirm whether you and members of your group are happy to be included in photographs and/or videos taken by us during the booking.

13.2. Where consent has been provided, you are consenting to us using any photographs or footage in connection with reporting on the use of the classroom online, on our social media platforms, or in printed promotional materials relating to similar educational, countryside, community or local attractions activities organised by us.

13.3. You agree that any video or audio recording or photographs you take during your booking are for personal, educational or internal organisational use only and cannot be used for any commercial purpose without our prior written consent.

14. Feedback

14.1. We are committed to ensuring that users of the classroom receive a quality experience. If you would like to provide feedback on any aspect of your booking, we would like to hear from you so we can learn and improve our service, systems and practices.

14.2. You can provide feedback by emailing holtclass@north-norfolk.gov.uk. Please be sure to include the date and description of your classroom booking.

15. Liability

15.1. We cannot be held responsible for any personal property, equipment, teaching materials or belongings brought to the classroom or site.

15.2. To the maximum extent permitted by law we shall not be liable for any loss, injury, liability, or damage of any kind resulting in any way from:

15.2.1. any errors in or omissions from information about the classroom, including negligence;

15.2.2. cancellation or rearranging of the booking;

15.2.3. attendance at, access to or use of the classroom or associated outdoor areas;

15.2.4. your use of any equipment, facilities or materials at the classroom or site;

15.2.5. any delay or failure in performance caused by reason of an act, event, non-occurrence, omission or accident beyond the reasonable control of us; or

15.2.6. any negligence of us or our employees, contractors or agents in connection with the performance of its obligations.

15.3. Without prejudice to the generality of the above, we shall not be liable to you for the actions or inactions of any other users, visitors or third parties at the classroom or site.

15.4. The aggregate liability of us in connection with any claim shall not exceed the price paid by you for the classroom booking.

16. General

16.1. A person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.

16.2. The headings used in this agreement shall not affect its interpretation.

16.3. We reserve the right to update these terms and conditions at any time and you should check them regularly.

16.4. If any part of these terms and conditions are held to be illegal or unenforceable, the validity and enforceability of any other part of the terms and conditions will not be affected.

16.5. These terms and conditions are governed by English Law. You and we both agree to the exclusive jurisdiction of the English Courts.

16.6. You agree to ensure everyone in your group complies with the Countryside Code.
